Today Wikipedia will be performing a complete blackout of its online website in protest of SOPA (Stop Online Piracy Act), a bill that has been alive since October 26, 2011, and a bill that has faced many opponents. Not only Wikipedia is protesting, sites like craiglist, Reddit, and Wired Magazine’s online page have followed suit. A lot of people, despite the amount of attention it has gotten in recent weeks, still have no idea what exactly SOPA is, and what it really means to them. Questions still arise, and a lot need to be answered, because the freedom of the Internet you use every day is at jeopardy.

 

Wikipedia’s blackout is a statement that is being made to show people that websites they use everyday, be it for information or entertainment, are at risk from being shut down entirely.

Dear Budget Supercommittee: It’s Time To Grow Up

The Supercommittee, if rumor, speculation and common sense can be credited,
now will shirk its role as political suicide bomber. The Supercommittee was
created in a fit of ambiguous revulsion against the truly gargantuan, obnoxious,
deficit. It got off on a macho, but false, premise:  that the path out was by
mutual pain: raising taxes and cutting entitlements.

Wrong premise.  There is a way to balance the budget.  Figure out  how to get
the economy growing at 4% (or even 5%) instead of its current stupefied 2%
range?  Extra growth compounds fast.  Accepting stagnation — economic growth
that barely keeps up with population growth — means that nobody prospers except
at the expense of others.  No wonder most Americans consider the country off
track.   Americans are committed to prosperity.

As economist Ike Brannon (and as has been here previously cited) observed: “The primacy of economic growth in generating tax
revenue cannot be overstated: the fastest post-war increases in tax revenue
growth occurred in 1997-2000 and 2004-2007, when revenues went up by nearly 50%
in each instance.  Tax rates did not go up at all during that time — the rapid
increase in revenue occurred because we were in a sustained period of strong
economic growth.”

There is a cornucopia of plausible, palatable,
recipes for such growth. Economic growth has been addressed by many
distinguished economists. In pondering economic growth dynamics future Nobel
laureate Prof. Robert Lucas laid out the questions he was formulating on behalf
of poorer countries struggling to achieve prosperity:

Is there some action a government … could take that would lead the … economy
to grow …? If so, what, exactly? …. The consequences for human welfare
involved in questions like these are simply staggering: Once one starts to think
about them, it is hard to think about anything else. (Lucas, “On the Mechanics
of Economic Development.” Journal of Monetary Economics 22: 3–42, p. 5;
italics original.)

Similar questions apply to America’s current predicament.  According to an
article in The Concise Encyclopedia of Economics, Lucas also did
important work on the optimal tax structure. His work led him to change a
fundamental belief. In the early 1960s, he had believed that “the single most
desirable change in the U.S. tax structure would be the taxation of capital
gains as ordinary income.” By 1990 he believed that “neither capital gains nor
any of the income from capital should be taxed at all.” He estimated that
eliminating capital income taxation would increase the U.S. capital stock by
about 35 percent. This belief in low or zero taxation of capital gains is often
attributed to believers in so-called supply-side economics. Lucas wrote, “The
supply side economists, if that is the right term for those whose research we
have been discussing, have delivered the largest genuinely free lunch that I
have seen in 25 years of this business, and I believe we would be a better
society if we followed their advice.”

The Transformers is a big hit and features groups of robots that transform from cars and planes and what-not into towering super-robots. One group, the bad guys, are called “Decepticons” because they deceive others and use that to get in close and either subvert or just destroy their prey.
It would appear that people who use the label “conservative” and who worm their way into conservative institutions  to then cloak their Progressivism in conservative lingo have taken their cue from this TV-show-turned-movie! Chief among them, from the high perch of what had been deemed the conservative voice of record, The National Review, is Decepticon In Chief, Kevin Williamson!- Kevin Williamson NRO Chief, or Decepticon Chief?
Take, for instance, Kevin’s recent stance on Gay Marriage:
Kevin Williamson NRO- “My own preference is to make marriage an entirely private affair and to remove the icy hand of politics from the marriage bed entirely. Marriage should be a strong, enforceable contract negotiated between the contracting parties; if the parties sought to have their union blessed by a religious authority, then the contract would have to comport with the rules spelled out by that authority. This would, incidentally, give the Catholic Church far greater actionable authority over the marital practices of Catholics than does the current system, and the same would be true for other religious congregations. If traditional modes of life really are self-evidently preferable to contemporary libertinism, then they should be able to compete in the marketplace of ideas.”

For Kevin “politics” should be “removed” from the “marriage bed.” Politics is simply policy, and if the state, which should be a creature of the popular sentiment, has no interest in upholding the sentiment and values of the People, then the state itself is perfectly useless and has no legitimacy. If the state is not able to protect, through laws if need be, the “way of life” of the People who form it, then what good is it to even have a state?
We’ll see that Williamson is saying one thing in public, and seems to be saying something else in “private” via Twitter. In public, Williamson is trying to sound reasonable, mature, and philosophical, and he seems to be trying to say “I am for traditional marriage, but I don’t think the state should be involved in defining marriage.”
In private, we will see, he treats those who use the Bible as the basis of their opposition to marriage like they are stupid, he even questions the very notion that God can speak to us through the Bible and treats this long-held belief among Christians as something preposterous!
The long and short of it is that Williamson’s argument for an “anything goes” social agenda is NOT the conservative argument, as evidenced, for instance, by the following:

This film is not what you think it is. The Undefeated — the Palin-praising documentary about the life and political career of the former Alaska governor — is not just two hours of liberals using the C word.

You tolerate no corruption, regardless of political party or pressure. You cut spending, slice taxes, stimulate business, and uphold the state Constitution. You’re then asked if you want to help change history by running on the ticket with Republican Presidential candidate Senator John McCain, a feat no other woman had ever attained, just as no other woman had ever been governor of Alaska. You offer yourself up in the name of service, and hit the campaign trail wide open.

The love that had been heaped upon you sours and turns to hatred and fear when the mainstream media sees you as a threat to the ascendancy of Barack Obama, heir to the American throne. To keep people oblivious to the truth of all that you had accomplished, they invest time demonizing you, attacking you, even trying to ignore you at times, although that doesn’t work too well, for PDS simply doesn’t allow for cold-turkey breakups. They create–or zero in on–a number of “gates,” such as Troopergate, Babygate, Clothinggate, Ethicsgate, Boobgate, Boogate, Visorgate, Blackgate, Emailgate, just to name a few.

After two decades and an impressive record, this is the thanks they gave Governor Palin. The greatest injustice, however, besides the attack on her family, is the attack on her record, no doubt. What we have spent our lives doing matters to us. The media, the left, and many on the right worked tirelessly to keep the light off what she’s managed to accomplish, knowing that the truth would wreck their political agendas, put an end to politics-as-usual, and destroy the various and sundry narratives they’ve worked so hard to create.

Nothing they have done has caused the Governor to sit down and shut up, however. Instead, she continues to fight for a restoration of America’s founding principles. To help matters, as if in answer to prayer, along comes Stephen Bannon with a documentary which has been heralded as a game-changer. The Undefeated is the truth on screen. It’s a knockout punch. It’s the refusal to allow others to rewrite a person’s history. The Undefeated is a movie that absolutely must be seen. It’s the story of Governor Palin’s career, so we know she’s done her part. Stephen Bannon and his team have done their part. Now, we must do our part.

So I challenge you, as I challenge me. Let’s ask ourselves the following questions: How much have we done to promote this movie? How many tickets have we bought that we will hand out to those we know need to see te film? Yes, that means people who aren’t her supporters–yet. As I reviewed here, everyone needs to see this documentary. Are we on Facebook and Twitter encouraging people to buy tickets? Do we actually believe The Undefeated can make a difference? If not, then we’re ignoring the plethora of reviews that attest to the power of this movie.

Governor Palin has some of the most active, enthusiastic supporters in the nation. Our support is based on the truth of who she is, what she has done, and what we know she can do. Let’s take that knowledge to more people. Let’s sell out these theaters, and let’s do everything in our power to get the message of her record to every person we can. If your answers to the questions I asked are positive and your efforts have been many, I issue yet another challenge to us all: go further, dig deeper, and work harder. We can help get the job done.

In more than 500 cities and towns in 25 states, silent sentries keep watch over intersections, snapping photos and shooting video of drivers who run red lights. The cameras are on the job in metropolises like Houston and Chicago and in small towns like Selmer, Tenn., population 4,700, where a single camera setup monitors traffic at the intersection of U.S. Highway 64 and Mulberry Avenue.

 

Wallace: Sorry for the “flake” question

I’d have put this into the earlier thread, but given the massive response to Chris Wallace’s question this morning to Rep. Michele Bachmann (R-MN), it seems fairer to give this a fresh look.  Not long after Wallace asked Bachmann if she was a “flake” for making a few gaffes over the last few years, Wallace heard an earful from his audience.  He faced the criticism head-on and apologized in a Fox News Sunday web video:

Give the man some credit. Wallace didn’t offer a “sorry if you were offended by my genius” non-apology apology. He deduced — rightly — that having the question overshadow the answer in an interview is usually a mistake, and accepted it as such. Wallace is right that Bachmann’s perceived seriousness is a legitimate topic for an interview, considering her status as a presidential candidate, but at the very least Wallace should have provided better contextual basis for his question. Had he said, “So-and-so called you a flake,” or better yet, “So-and-so questioned your seriousness in light of these gaffes,” he would have opened the same topic but in a better and more fair manner for Bachmann to respond.

As Wallace says, every day is a learning experience. More than a few people in his position would be tempted to dig in and defend a poor choice. Kudos to Wallace for learning a lesson and admitting to it.

Still, when will the national media start questioning Obama’s seriousness if rhetorical gaffes are the determining factor, as they apparently are for Republicans such as Bachmann, Sarah Palin, and George W. Bush? That’s a question I ask almost every day in the Obamateurism feature.

Bear witness to a listless and ineffective leader who is beatable.  Carter Redux.

Americans have grown weary of the flailing Obama economy.  So potent is the public’s displeasure, the President’s support is fast eroding.  Most notably, among key constituencies he will need for 2012. 

With the polling sugar high of Bin Laden’s death all but gone, and perpetually poor economic data to boot, even an unnamed Republican opponent defeats the President in two of three surveys released this month.    

For a GOP field that is routinely derided as weak and unexciting — a leftist narrative — these polls, if anything, remind us that Americans are looking for a competent alterative, and that the race will be competitive. 

A Republican candidate who offers a fiscally sound, pro-growth, jobs-centric agenda will provide a sharp contrast to this White House.  With a clear articulation of substantive ideas, Conservatives should press their case.

The President’s job approval, once as high as 76%, continues to trend downward.  It stands now at 47.7% in the Real Clear Politics average of polls.  Significantly, Obama is losing ground among Hispanics, a key group he carried overwhelmingly in 2008.  And, among women, an AP poll found that only 48% believe he deserves reelection, a drop of nearly 10 points from AP’s polling just last month.       

More, Independent voters are abandoning Obama in droves.  This vital voting bloc has long since lost faith in the President’s chosen course heading, one that will transform our nation into a ghost ship of centralization.        

A recent Bloomberg national poll clearly reflects this drop.  Less than one-fourth of Independents, only 23%, said they would vote for Obama in 2012.  The same poll found that just 30% of all voters were “certain” to support his reelection; 66% said the country was on the wrong track

An unconscionable lack of presidential leadership, bad policy, ballooning debt, and a sputtering economy best explain such widespread pessimism.  For many, America is fast becoming a nation unrecognizable. 

Indeed, nearly 60% of Americans currently disapprove of this Administration’s handling of the economy.  More specifically, on jobs, the national debt and the federal deficit, voter reproach is rising.  These three key issues register above, or near, 60% disapproval.  Moreover, 80% of voters say “the economy is in poor shape.”  An unhealthy condition that is intolerable.

Despite these numbers, Americans have yet to see the President take a more active role, most recently in the debt limit negotiations that have now stalled.  Rep. James Clyburn (D-SC) says Obama doesn’t have the “time” to go these meetings. 

But now, he has no choice.  In fact, negotiations for a final debt deal have already forced Obama into the fray.  Voters, however, are skeptical about just what impact that will have on reducing debt

Sixty-two percent believe that the spending cuts agreed upon will be insufficient.  Their cynicism, of course, is warranted.  The profligate spending continues apace, while Democrats blame President Bush for the current debt crisis.  But does anyone think the voters will buy the left’s deflection of responsibility using Bush as a scapegoat, a bogeyman?

Our national debt is up 35% since Obama took office and Democrats have been the loudest cheerleaders for deficit spending.  And this, the public knows. 

Congressman Clyburn, you may recall, once remarked that America had to spend its way out of recession — Keynesian hogwash that fiscally conscious Americans reject.  The rising debt accumulated under this misguided scheme has weighed down what our economy needs most: job growth.    

It’s not surprising, then, that for those for whom job creation is a key concern, Bloomberg found Republicans with a sizable 12-point advantage in “voter intensity.”  As the jobs picture grows ever more perilous and our economic outlook more grim, the “intensity” gap should widen further, and with it, calls for a new direction. 

Note: 86% of voters are very concerned about unemployment, a level not seen since before the November 2010 elections.  

Incidentally, it is worth mentioning that administration loyalists will read these polls as mere snapshots with the presidential race still more than a year away.  This is wishful thinking. Voters have roundly rendered their dissatisfaction…consistently, and for some time.  The White House has no one to blame but itself.  

The President does not have a cogent message on the economy, if he ever did, and our position abroad erodes further without a definable foreign policy.  As one of his advisors infamously put it, Obama is right at home “leading from behind.”

With unpopular policies and few results, even his signature “accomplishment,” ObamaCare, is loathed.  Most Americans want to be rid of it.  The most recent poll shows that 53% of Americans favor repeal of this monstrosity.  Less than 1/3 believe it will be beneficial to the country.        

For the left-minded, our nation’s sick economic condition is cause for deep political unease.  They ought to be worried.  As Senator Dick Durbin (D-IL) recently conceded, liberals know that Obama’s economic policies “will be held accountable” by voters. 

Convincing the public that conditions are improving — when most know they are not — will be a steep challenge.  Make ready the teleprompter.

Wednesday night, President Obama addressed the nation and explained his plans for bringing home American troops from Afghanistan after a successful surge operation. Obama referred to himself over a dozen times but never mentioned General Petreaus, the architect of the troop surge. Obama called the surge one of the most difficult decisions he’s had to make as President, in a speech directed towards electoral politics.

The pace of the withdrawal is a setback for his top commander in Afghanistan, Gen. David H. Petraeus, who has been named director of the Central Intelligence Agency. General Petraeus, who helped write the Army’s field manual on counterinsurgency policy, did not endorse the decision, said another official, though both Defense Secretary Robert M. Gates and Secretary of State Hillary Rodham Clinton both accepted it with reservations.

The following are President Obama’s prepared remarks as released by the White House:

Good evening. Nearly ten years ago, America suffered the worst attack on our shores since Pearl Harbor. This mass murder was planned by Usama bin Laden and his Al Qaeda network in Afghanistan, and signaled a new threat to our security – one in which the targets were no longer soldiers on a battlefield, but innocent men, women and children going about their daily lives.

In the days that followed, our nation was united as we struck at Al Qaeda and routed the Taliban in Afghanistan. Then, our focus shifted. A second war was launched in Iraq, and we spent enormous blood and treasure to support a new government there. By the time I took office, the war in Afghanistan had entered its seventh year. But Al Qaeda’s leaders had escaped into Pakistan and were plotting new attacks, while the Taliban had regrouped and gone on the offensive. Without a new strategy and decisive action, our military commanders warned that we could face a resurgent Al Qaeda, and a Taliban taking over large parts of Afghanistan.

For this reason, in one of the most difficult decisions that I’ve made as President, I ordered an additional 30,000 American troops into Afghanistan. When I announced this surge at West Point, we set clear objectives: to refocus on Al Qaeda; reverse the Taliban’s momentum; and train Afghan Security Forces to defend their own country. I also made it clear that our commitment would not be open-ended, and that we would begin to drawdown our forces this July.

Tonight, I can tell you that we are fulfilling that commitment. Thanks to our men and women in uniform, our civilian personnel, and our many coalition partners, we are meeting our goals. As a result, starting next month, we will be able to remove 10,000 of our troops from Afghanistan by the end of this year, and we will bring home a total of 33,000 troops by next summer, fully recovering the surge I announced at West Point. After this initial reduction, our troops will continue coming home at a steady pace as Afghan Security forces move into the lead. Our mission will change from combat to support. By 2014, this process of transition will be complete, and the Afghan people will be responsible for their own security.

We are starting this drawdown from a position of strength. Al Qaeda is under more pressure than at any time since 9/11. Together with the Pakistanis, we have taken out more than half of Al Qaeda’s leadership. And thanks to our intelligence professionals and Special Forces, we killed Usama bin Laden, the only leader that Al Qaeda had ever known. This was a victory for all who have served since 9/11. One soldier summed it up well. “The message,” he said, “is we don’t forget. You will be held accountable, no matter how long it takes.”

The information that we recovered from bin Laden’s compound shows Al Qaeda under enormous strain. Bin Laden expressed concern that Al Qaeda has been unable to effectively replace senior terrorists that have been killed, and that Al Qaeda has failed in its effort to portray America as a nation at war with Islam – thereby draining more widespread support. Al Qaeda remains dangerous, and we must be vigilant against attacks. But we have put Al Qaeda on a path to defeat, and we will not relent until the job is done.

In Afghanistan, we’ve inflicted serious losses on the Taliban and taken a number of its strongholds. Along with our surge, our allies also increased their commitments, which helped stabilize more of the country. Afghan Security Forces have grown by over 100,000 troops, and in some provinces and municipalities we have already begun to transition responsibility for security to the Afghan people. In the face of violence and intimidation, Afghans are fighting and dying for their country, establishing local police forces, opening markets and schools, creating new opportunities for women and girls, and trying to turn the page on decades of war.

Of course, huge challenges remain. This is the beginning – but not the end – of our effort to wind down this war. We will have to do the hard work of keeping the gains that we have made, while we drawdown our forces and transition responsibility for security to the Afghan government. And next May, in Chicago, we will host a summit with our NATO allies and partners to shape the next phase of this transition.

We do know that peace cannot come to a land that has known so much war without a political settlement. So as we strengthen the Afghan government and Security Forces, America will join initiatives that reconcile the Afghan people, including the Taliban. Our position on these talks is clear: they must be led by the Afghan government, and those who want to be a part of a peaceful Afghanistan must break from Al Qaeda, abandon violence, and abide by the Afghan Constitution. But, in part because of our military effort, we have reason to believe that progress can be made.

The goal that we seek is achievable, and can be expressed simply: no safe-haven from which Al Qaeda or its affiliates can launch attacks against our homeland, or our allies. We will not try to make Afghanistan a perfect place. We will not police its streets or patrol its mountains indefinitely. That is the responsibility of the Afghan government, which must step up its ability to protect its people; and move from an economy shaped by war to one that can sustain a lasting peace. What we can do, and will do, is build a partnership with the Afghan people that endures – one that ensures that we will be able to continue targeting terrorists and supporting a sovereign Afghan government.

Of course, our efforts must also address terrorist safe-havens in Pakistan. No country is more endangered by the presence of violent extremists, which is why we will continue to press Pakistan to expand its participation in securing a more peaceful future for this war-torn region. We will work with the Pakistani government to root out the cancer of violent extremism, and we will insist that it keep its commitments. For there should be no doubt that so long as I am President, the United States will never tolerate a safe-haven for those who aim to kill us: they cannot elude us, nor escape the justice they deserve.

My fellow Americans, this has been a difficult decade for our country. We have learned anew the profound cost of war — a cost that has been paid by the nearly 4500 Americans who have given their lives in Iraq, and the over 1500 who have done so in Afghanistan – men and women who will not live to enjoy the freedom that they defended. Thousands more have been wounded. Some have lost limbs on the field of battle, and others still battle the demons that have followed them home.

Yet tonight, we take comfort in knowing that the tide of war is receding. Fewer of our sons and daughters are serving in harm’s way. We have ended our combat mission in Iraq, with 100,000 American troops already out of that country. And even as there will be dark days ahead in Afghanistan, the light of a secure peace can be seen in the distance. These long wars will come to a responsible end.

As they do, we must learn their lessons. Already this decade of war has caused many to question the nature of America’s engagement around the world. Some would have America retreat from our responsibility as an anchor of global security, and embrace an isolation that ignores the very real threats that we face. Others would have America over-extend ourselves, confronting every evil that can be found abroad.

We must chart a more centered course. Like generations before, we must embrace America’s singular role in the course of human events. But we must be as pragmatic as we are passionate; as strategic as we are resolute. When threatened, we must respond with force – but when that force can be targeted, we need not deploy large armies overseas. When innocents are being slaughtered and global security endangered, we don’t have to choose between standing idly by or acting on our own. Instead, we must rally international action, which we are doing in Libya, where we do not have a single soldier on the ground, but are supporting allies in protecting the Libyan people and giving them the chance to determine their destiny.

In all that we do, we must remember that what sets America apart is not solely our power – it is the principles upon which our union was founded. We are a nation that brings our enemies to justice while adhering to the rule of law, and respecting the rights of all our citizens. We protect our own freedom and prosperity by extending it to others. We stand not for empire, but for self-determination. That is why we have a stake in the democratic aspirations that are now washing across the Arab World. We will support those revolutions with fidelity to our ideals, with the power of our example, and with an unwavering belief that all human beings deserve to live with freedom and dignity.

Above all, we are a nation whose strength abroad has been anchored in opportunity for our citizens at home. Over the last decade, we have spent a trillion dollars on war, at a time of rising debt and hard economic times. Now, we must invest in America’s greatest resource – our people. We must unleash innovation that creates new jobs and industry, while living within our means. We must rebuild our infrastructure and find new and clean sources of energy. And most of all, after a decade of passionate debate, we must recapture the common purpose that we shared at the beginning of this time of war. For our nation draws strength from our differences, and when our union is strong no hill is too steep and no horizon is beyond our reach.

America, it is time to focus on nation building here at home.

In this effort, we draw inspiration from our fellow Americans who have sacrificed so much on our behalf. To our troops, our veterans and their families, I speak for all Americans when I say that we will keep our sacred trust with you, and provide you with the care, and benefits, and opportunity that you deserve.

I met some of those patriotic Americans at Fort Campbell. A while back, I spoke to the 101st Airborne that has fought to turn the tide in Afghanistan, and to the team that took out Usama bin Laden. Standing in front of a model of bin Laden’s compound, the Navy SEAL who led that effort paid tribute to those who had been lost – brothers and sisters in arms whose names are now written on bases where our troops stand guard overseas, and on headstones in quiet corners of our country where their memory will never be forgotten. This officer – like so many others I have met with on bases, in Baghdad and Bagram, at Walter Reed and Bethesda Naval Hospital – spoke with humility about how his unit worked together as one – depending on each other, and trusting one another, as a family might do in a time of peril.

That’s a lesson worth remembering – that we are all a part of one American family. Though we have known disagreement and division, we are bound together by the creed that is written into our founding documents, and a conviction that the United States of America is a country that can achieve whatever it sets out to accomplish. Now, let us finish the work at hand. Let us responsibly end these wars, and reclaim the American Dream that is at the center of our story. With confidence in our cause; with faith in our fellow citizens; and with hope in our hearts, let us go about the work of extending the promise of America – for this generation, and the next. May God bless our troops. And may God bless the United States of America.

 

Republicans Urge Obama to Raise Fuel Efficiency by 100 Percent

The Obama green dreams have recently been awarded assistance by nearly forgotten former Republicans officials, desperate to find relevance. The collection of fifteen former governors, congressmen agency officials are joining in with the President and Democrats who have long been of the opinion that the American public will only do what’s “right” if they are left with no other options. In the world of green, this translates into higher efficiency standards.

“I’m just very passionate about the environment,” said former Rep. Sherwood Boehlert (R-N.Y.), who spearheaded the letter to President Barack Obama. “We want the administration to know there are serious-minded Republicans who are well informed on the issue who urge him to take aggressive action.”

One wonders if half of this effort is just to get kudos for being “one of the good ones” when reading appeals such as Boehlert’s. But Boehlert and her fellow enlightened Republicans weren’t nearly done patting themselves on the back. The actual letter proudly reads like a group that has really done their research on an industry that is the lifeblood of our economy.

War Powers Act: Right problem, wrong tool

Senators McCain and Kerry have probably made moot (at least for now) the War Powers threat that has been fitfully gathering steam in the House.  And that’s probably fine, as a War Powers showdown is a low-payoff proposition between now and November 2012.  It is correct to worry about Obama’s non-hostile kinetic military action in Libya being mishandled and problematic,  but the War Powers Act is a bad tool that would make things worse, not better.

In its own way, the War Powers Act is part of the same problem posed by the NHKMA in Libya: it tries to denature and bureaucratize war.  The principal reason it is bad law derives from the fact that it is unenforceable – and ultimately unnecessary – on its own terms.  To enforce the War Powers Act when a president refuses to comply with it, Congress must do what the Constitution already empowered it to do, before the War Powers Act was ever thought of:  deny funds to the president’s military operations.

The War Powers Act was an attempt to interpolate a less explosive option for stage-managing this form of confrontation, by imposing a deadline by which negotiations would have to start.  The problem with this isn’t the demand for inter-branch negotiation, however – that is actually a given.  The problem is that military action, while it’s in progress, is peculiarly unsuited to being argued about and temporized on in this manner.

Many Americans have recognized – mainly because of the Vietnam War – that the ambivalent use of force, subject to unnatural constraints and open-ended vetoes, is a doomed enterprise.  The War Powers Act tries, however, to impose an inherent ambivalence on any form of military action that does not involve a Congressional declaration of war.

That attempt ignores the summary nature of military action (and does so, ironically, on a principle similar to that governing Obama’s action in Libya).  The War Powers Act pretends that military action can, as a matter of routine, be made subject to arbitrary deadlines, or renegotiated as it goes along, without significant losses to the coherence and strategic integrity of national policy.  It treats the use of force as if it is a fully “domesticable” arm of policy – as if the intrinsic implications of employing force abroad do not require respect and adjustment from partisan politics.

But military force can’t be domesticated in this way, nor should we want it to be.  It gets people killed and summarily resets the relations between nations – and that’s the whole point of it.  If the president and Congress can’t agree on its use, then having recourse only to the Constitution’s “nuclear option,” whereby Congress withholds funds, is the best guarantee that decisions about military action will be made, by both branches, with the prior consultation and the extreme seriousness they merit.

Oddly enough, Obama’s characterization of his action in Libya – so bizarre to the ears of the American people – is the same kind of attempt to treat military action as if it is not the high-risk, transformative barn-burner it inherently is.  When Obama says the US is not engaged in “hostilities” with Libya, he is speaking from the same text used by Samantha Power when she advocated intervening in Libya based on the putative “responsibility to protect” (R2P).  According to this text, it is indeed possible to bomb another country for three months without being in “hostilities”:  the key is pursuing an objective that makes moot the political factors of recognized sovereignty and national borders.

R2P, as defined by its proponents, is just such an objective.  By the R2P formulation, endangered civilian populations (except those in Syria) trump sovereignty.  Bombs and killing are not hostilities, if your intention is to protect a civilian population with them – and if you explicitly disavow any intention of producing regime change with them, as Obama has done.

This rightly seems absurd to us; it is an attempt to redefine some very basic concepts, like sovereignty and hostilities.  Indeed, it’s more than an attempt:  the Obama administration is behaving as if the redefinition is already a fait accompli, in spite of the fact that no such consensus has ever developed among the nations.

But the current result of the NHKMA in Libya is the best counter-evidence to the Obama postulate.  Libya’s civilians are not being protected; NATO, Qaddafi, and the rebel forces have all been killing and injuring them.  Bombs are bombs, and they do what bombs do.  They can’t protect civilians independently of the political situation.  The decisive factor is who has sovereignty over Libya; the quickest, most effective way to improve conditions for Libyans is to do the thing Obama has sworn he won’t use force to do:  change the regime for the better.

That is a human reality that cannot be suspended.  But Obama is trying to redefine the nature of both politics and force, to fit an ideological perspective on the nation-state.  The War Powers Act is also an attempt to redefine the nature of force – to fit internal politics.  Neither enterprise can survive contact with reality.

I agree with those who believe Obama is prosecuting the action in Libya very poorly.  Qaddafi could have been gone 10 weeks ago – or the US could have declined to participate.  Either would have been preferable to the state of affairs Obama’s “leadership from behind” has produced at the 90-day mark.  But compliance with the War Powers Act would not change that for the better.  It would only add a layer of bloviating bureaucratic oversight, which is invariably injurious to the effective use of force.

This doesn’t mean presidents shouldn’t need congressional agreement to commit to military action.  What presidents have done heretofore is present purposes to Congress and seek authorization – which they know they have to do because Congress holds the power of the purse.

Congress saddled itself with the War Powers Act, however, and had to make some kind of gesture at the 90-day mark.  The better option is what Congress can do regardless of whether there’s a War Powers Act or not.  McCain-Kerry is not a bad start, but it will require vigilance and teeth.

Congress should wait, for a time, to see if Qaddafi’s exit can be procured in some way; it might be.  Congress should watch Obama’s commitment of force with a critical eye, and a clear idea of what it has the votes to declare “too much.”  And if Qaddafi hangs on through the summer, and Obama persists in the fiction that NATO dropping bombs on Libya is a sovereignty-neutral means of “protecting civilians,” then Congress can – and should – cut his funding.

All of that can be done based on the original law of our nation.  Using military force is too significant, risky, and inherently transformative an act of policy to be undertaken on the basis of tentative permissions and arbitrary deadlines.  There is no place in it either for exotic philosophical distinctions:  the normal definitions of sovereignty and hostilities, and the traditional justifications for force, are a network of conventions that we rely on to guard against breaches of the peace.

The American people in 2011 seem to understand these things better than those in office, reacting with a traditional and very proper disquiet to the proliferation of military actions abroad.  The people are right about that.  And military force, above all others, is a matter in which a disagreement between the president and Congress merits a crisis of government and an unambiguous resolution.

China’s Espionage Threat

When we think of espionage we tend to think in terms of Europe, Central Europe in particular, the bleak, dark cityscapes of Berlin and Vienna, the border cities of the Cold War. The Wall, Checkpoint Charlie, clandestine meets in the shadow of the Prater or the Brandenburg Gate.

David Wise thinks we desperately need to add an Eastern perspective to our thinking on espionage. Judging from the evidence presented in his new book, Tiger Trap:America’s Secret Spy War with China, he’s far from mistaken.

China is undoubtedly the biggest espionage threat this country now faces. The Chinese, for cultural and historical reasons, don’t view espionage, either purpose or technique, the way we do.  Whereas Americans (and Russians too) think in terms of targets against which distinct operations are planned and carried out, the Chinese, according to Wise, view the process as putting together a mosaic, of gathering small pieces of information to construct an overall picture.  What the Chinese do is send out thousands of tourists, officials, and agents to pick up whatever they can (Wise compares the process to analyzing the sands of a beach — each returns to China with a single grain of sand).  

Needless to say, the PRC does not overlook ethnic Chinese who have settled in foreign countries, particularly the United States.  The Chinese Ministry of State Security (MSS) constantly recruits in overseas Chinese communities, often pleading with potential recruits to “help” the mother country, which remains poor and vulnerable.  These requests often don’t match our preconceptions concerning “espionage” as such, comprising as they do the search for that one single sand-grain of information that will fill out the overall mosaic.

Misunderstanding of the Chinese intelligence mindset has led to serious failings in U.S. counterintelligence efforts. Wise recounts disaster after disaster in the recent decades.

  • In operation Tiger Trap, which give the book its title, both of the FBI’s leading West Coast counterintelligence agents were sleeping with one of China’s major U.S. assets, Katrina Leung, who provided massive amounts of information to China while also building a lucrative personal financial empire. She effectively walked when a judge — a Clinton appointee, naturally enough — chose to interpret a badly-drafted plea-bargaining passage as “prosecutorial misconduct”. (Wise strongly implies — though he does not state outright — that at least one of the FBI agents was cooperating fully with Leung. He walked too.)
  • The Wen Ho Lee case, probably the only name most readers will readily recognize, in which Lee’s life was disrupted and his career virtually destroyed before it was discovered that the classified material in question — concerning the W-88 Trident warhead — didn’t come from his workplace at Los Alamos at all but very likely from within the Pentagon.
  • The Jeff Wang case, in which a bogus tip resulted in the perfectly innocent Wang being targeted as a Chinese agent. Although he was at last cleared, the case also resulted in the firing of the one of the FBI’s most promising Chinese-American agents, Denise Woo, a family friend of Wang’s who saw that he was innocent and tried to persuade her superiors of the fact. (It turned out that Wang had been targeted by a leading Chinese informant, a relative of Wang’s who wanted revenge for a family misunderstanding. The Chinese community tends to be very tightly knit.)
  • The Anubis case, involving Wen Ning, a Chinese diplomat who had served the FBI well for years as an agent-in-place. After he settled in the U.S., it developed that Wen and his wife had a business on the side — smuggling advanced computer chips to the PRC. Technically, this is not a case involving a double agent as much as a man who seen his opportunities and took ‘em.

That’s only the beginning — the sad stories go on and on. The best that can be said about most of these operations is that they are not the FBI’s finest hour. (Though to be fair, we do get to see a few successful operations – but by no means enough.)

This is scarcely acceptable.  China is certain to be our major adversary for a good long period of the upcoming century. We have a lot to learn about China’s plans, goals, and its methods of achieving them. Tiger Trap serves as a fine introduction. Reading it is a recommended first step.

As a side note, I find the book’s structure very interesting. Rather than a strict chronological account, Wise uses the Leung saga as a framework, telling the story in alternate chapters while devoting the other  chapters to background and related or contemporary incidents. It’s an original and illuminating technique, of a kind that’s rarely encountered in non-fiction. I’d like to see more of this kind of thing.

Did the Supreme Court Tip its Hand on ObamaCare?

On June 16 the U.S. Supreme Court sent a case (U.S. v. Bond) back to a lower court on Tenth Amendment grounds. The ruling, written by Justice Anthony Kennedy (the Court’s “swing vote”), hints that ObamaCare just might be ruled unconstitutional. How? Justice Kennedy’s opinion in U.S. v. Bond showed he still believes the federal government is restricted by the enumerated powers as listed in the U.S. Constitution. His viewpoint was expressed in a case the Lifetime network is probably making a movie about right now.

            In this case, Carol Anne Bond learned that her best friend, Myrlinda Haynes, was pregnant. Bond thought that was great until she found out that the baby was fathered by her husband of 14 years, Clifford. Naturally, Bond, a microbiologist residing in suburban Philadelphia, wanted revenge. She began in the usual way by threatening Haynes over the telephone: “I [am] going to make your life a living hell.” Subsequently, Bond’s attempts to make Haynes life a “living hell” got her convicted for harassment in 2005.

            Bond, however, was still out for revenge. Bond next smeared poisonous chemicals, such as an arsenic-based chemical (remember she is a microbiologist) on Haynes’ car door handle, mailbox, and other places. Haynes got a burn from the chemicals and reported it to the police. The police, however, didn’t know what to make of Haynes’ claims. But then the U.S. Postal Inspection Service got involved because the mailbox had been tampered with. After its investigation, Bond was charged with a violating U.S. Code, Section 229, a statute that then prompted federal prosecutors to also throw the 1993 Chemical Weapons Convention at Bond.  Bond subsequently pleaded guilty in federal court and got a six-year sentence and nearly $12,000 in fines and restitution.

The use of this federal treaty on chemical weapons, however, was a bit much, so Bond’s lawyers appealed by arguing that using the federal government’s Chemical Weapons Convention against Bond is unconstitutional under the Tenth Amendment. (“The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.”)

On appeal, the 3rd Circuit then ruled that Bond lacked standing to challenge her conviction, finding that only states, not individuals, can bring challenges under the Tenth Amendment.

With this constitutional question in the balance, the U.S. Supreme Court agreed to take the case and heard it last January.  Former Solicitor General Paul Clement represented Bond at the Supreme Court hearing.  Clement argued that “the structural provisions of the Constitution are there to protect the liberty of citizens.” He articulated that states have the authority to resolve their own criminal justice cases — some international treaty on chemical weapons shouldn’t preclude this state right.

Which gets us back to Justice Kennedy and his tell on how he might rule on ObamaCare.  Justice Kennedy said at the hearing: “The whole point of separation of powers, the whole point of federalism, is that it inheres to the individual and his or her right to liberty; and if that is infringed by a criminal conviction or in any other way that causes specific injury, why can’t it be raised?” This made court watchers wonder if this might forecast how Justice Kennedy might vote on ObamaCare.

Then, on June 16, the Court ruled 9-0 in favor of Bond that the U.S. Congress overstepped its authority by infringing on powers reserved to the states under the Tenth Amendment. (Bond, however, will have to make and win the Tenth Amendment argument in a lower court, as the Supreme Court only sent the case back down to the lower court while saying that Bond can fight her conviction on Tenth Amendment grounds.)  

So here’s where it gets interesting for those wondering how the Court will vote on ObamaCare. The Obama Administration’s argument is that it can mandate that people buy government-approved health insurance under the power the Constitution’s Commerce Clause (The U.S. Congress shall have the power “To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes….”) gives the federal government. The Commerce Clause has been viewed to be an expansive power by the Supreme Court; for example, the Court found in Wickard v. Filburn (1942) that the federal government can even regulate whether a farmer can grow wheat for his chickens. But the Court has never found that the government can mandate that citizens actively do something, such as purchase a product. This is why Justice Kennedy’s opinion expressed in U.S. v. Bond is interesting, as it indicates his preference for state rights under the Tenth Amendment.

For example, in his opinion on U.S. v. Bond, Kennedy quoted the Supreme Court case New York v. U.S. (1992): “Federalism secures to citizens the liberties that derive from the diffusion of sovereign power.” And then Justice Kennedy said, “[Federalism] protects the liberty of all persons within a state by ensuring that laws enacted in excess of delegated governmental power cannot direct or control their actions…. By denying any one government complete jurisdiction over all the concerns of public life, federalism protects the liberty of the individual from arbitrary power. When government acts in excess of its lawful powers, that liberty is at stake. The limitations that federalism entails are not therefore a matter of rights belonging only to the states.”

So in U.S. v. Bond Justice Kennedy found that Congress exceeded its constitutional authority. Let’s hope he’ll do the same when Obamacare makes it to the U.S. Supreme Court.

Blair defends “liberal interventionist” stance at Israeli Presidential Conference

If the opening plenary session of the Israeli Presidential Conference suffered from a lack of seriousness, the second and final plenary session of the first day brought gravitas by the truckload.  Titled “Nation, Interests, and Ethics in the Journey Towards Tomorrow,” it featured a speech by Israeli President Shimon Peres and a series of talks by Tony Blair, Bernard-Henri Levy, and Professor Amos Oz, moderated by television anchorman Oren Nahari.  The remarks from all were certainly provocative on a series of ethical questions that changed a bit with each speaker.

Peres received a standing ovation when he took the podium, and expressed his optimism that the peace process has not irretrievably collapsed.  He called on both the Israeli government and the Palestinians to return to direct negotiations (a faint wish on both parts at this point) and insisted that the region is still closer to peace than war.  “I can see the end of the process,” Peres said. “I remain a believer.”

He didn’t eschew criticism of the Palestinians and their backers.  Peres blasted Iran and the “shadow” it casts over the region with its funding of Hamas and Hezbollah, and called the five-year kidnapping of Gilad Shalit “a disgrace to human dignity.”

Still, Peres sounded a couple of discordant notes, especially the notion that “in the void of world government, self-government is the best alternative.”  Given Israel’s precarious position, one might think that the last thing an Israeli would wish is rule by the UN or any other body remotely like it.  The entire raison d’être of Israel is to allow Jews to have a homeland that they can secure against the rest of the world, borne out of obvious necessity by the ghastly Holocaust that killed six million Jews in supposedly enlightened Europe.  Peres got a warm and respectful reception at the end of his speech, but whether or not that was a factor, few stood as he walked off stage.

In fact, I had a delightful conversation with my airport transportation driver on the way to the conference.  He and his wife are natives of Israel, and his father fought in the War of Independence.  His three sons all served, the driver proudly told me, and he shared that Israelis often send teenagers to visit the extermination camps, at least those that are left.  That impresses on young Israelis the need to serve their country and to fight to remain free when necessary.

Blair had the most interesting speech, and perhaps the most timely.  Nahari challenged him on interventions by the West in places like Iraq, Afghanistan, and Libya, while noting the “embarrassment” of the world’s shrug at Syria for doing pretty much what Moammar Gaddafi did in Libya.  Blair sidestepped that question — one cannot imagine a retired Prime Minister going after a successor on that point, especially while the UK is still engaged against Gaddafi — but did argue that idealism and pragmatism are not always separate.  “In an interconnected, independent world,” Blair said, national interests can and often do “represent values.”

Action has its consequences, but Blair also warned that inaction is an explicit decision with consequences of its own.  In this, Blair explicitly mentioned the Iranian pursuit of nuclear weapons and warned that a failure to act that resulted in mullahs being armed with nukes would have catastrophic consequences.  Blair proudly called himself a “liberal interventionist” and insisted that interventions tailored to specific and achievable ends that promote values of freedom and liberty are a valid expression of those national values.

The former British PM also defended Western support for Israel in rather unique terms.  Neocons in the US often express the hope that Iraq can serve as a model to the rest of the Arab nations, but Blair said that Israel is “a model for the region.”  “Come and see what Israel has done in 60 years,” Blair said to thunderous applause, pointing out that it’s Israel’s freedom that allowed for its advances.  “Freedom is not a passing phase,” Blair emphasized, “it is the condition that defines the human spirit.”  And for that, Blair got the standing ovation at the end that he also received at the beginning.

Clinton Unzipped: One of the Worst Presidents Ever

Conventional wisdom has it that Bill Clinton was a flawed man, but a good president.  Let’s blast that claptrap to smithereens with a Fast and Furious AK-47, because Bill Clinton was an unadorned calamity for our national security, and, in all probability, remains one to this day.

In the last week, we learned some piquant facts about Clinton’s associates: First, his wife’s most intimate aide, Huma Abedin, has a Saudi mother and brother who are both prominent members of the Muslim Brotherhood. 

Glamour girl Abedin accesses our most sensitive national secrets through her longtime, joined-at-the-hip relationship with Secretary of State Hillary Clinton.  This jihadist penetration into our government’s innermost sanctums is A-OK with Bill Clinton, who risibly presided over Abedin’s wedding to proud pervert Anthony Weiner.

And then there’s Clinton’s former chief of staff, CIA chief Leon Panetta, who we now discover may be hiding a colorful past of Communist entanglements.  Naturally, Panetta’s odd choice of friends proved no impediment to his confirmation as Secretary of Defense; the Senate just unanimously approved him.

This Unholy Trinity in the news  — Weiner, Abedin, and Panetta — brings back memories of the many splendored treacheries of the Clinton years.  It seems just yesterday that Bill and Hill were guzzling down illegal campaign contributions from China and handing them advanced military technology in exchange for cash.  And who can forget the Clintons’ most heinous betrayal of all, which was…what, exactly?

We’ll probably never know because Sandy Berger took care of that.  Remember him?

 ”Sandy Burglar” is the light-fingered bandit who served as Clinton’s National Security Advisor and pled guilty to stealing and destroying classified documents from the National Archives.  At Clinton’s behest, Berger was prowling the Archives to prepare testimony for the 9/11 Commission.

By his own admission, Berger secretly stashed classified documents in his socks on multiple occasions, hid them under a construction site trailer, snuck back to retrieve them, and then cut them to shreds.

Purely by accident, of course!

By the way, whatever happened to Sandy Berger?  Maybe he and a certain disgraced ex-congressman can open up a high-end Berger and Weiner stand.

As the country reeled from 9/11 and our national unity crumbled under leftist assaults against the war, Clinton rushed in to help.  Using the unmatched authority of his former office to unite the country, Clinton urged “every American” to see Michael Moore’s steaming pile of enemy propaganda, Farhenheit 9/11.

So what damning secrets were in those documents that Berger risked jail time to destroy?  Opportunities Clinton had to take out bin Laden and rejected?  His malfeasance in handling the Millennium terrorist plot?  Facts about the unanswered bombings under his careless watch: the World Trade Center in 1993, Khobar Towers, the USS Cole, the American embassies in Kenya and Tanzania, and Oklahoma City?  And what else don’t we know about the mysterious downing of TWA Flight 800?

Here’s a Clintonian snake pit we should smack a stick into: after receiving campaign cash, Clinton appointed Abdurahman Alamoudi to select and train Muslim chaplains for the U.S. military.  Alamoudi is a charming, industrious man, who, nonetheless, is now serving 23 years in federal prison for Al Qaeda-linked plots.  So far, only one of his protégé chaplains has been arrested for espionage.

The craven media stampeded to Juneau to breathlessly inspect every jot and title of Sarah Palin’s old emails.  All that they discovered is that she’s a God-fearing, hardworking, honorable woman who loves her family and country.

How about a little media curiosity about Bill and Hill’s squalid antics, past and present?  Bill continues to troll the world, vacuuming up unknowable quantities of foreign cash for his foundation, while Hill is perfectly positioned to deliver the quid pro quo in James Madison’s old job, Secretary of State.  And the lovely Huma can quietly broker the deals.

Let me ask you the most basic question: When you see photographs of Hillary and Huma showily whispering together, do you have any confidence about whose side they’re on?  How about when you see Bill yukking it up with various Arab potentates or Vladimir Putin?  You do?  Really?

When pathetic Anthony Weiner committed a complete Twitter-ectomy of his career, the spotlight suddenly turned on his most curious marriage.  A devout Muslim married to a Jew, with no repercussions from the excitable elements back home.  An elegant sylph with expensive tastes married to a dorky jerk on government pay.  And a rushed romance that seemed oddly timed to suggest a deal: the Clintons’ support for Weiner’s New York mayoral ambitions, in exchange for him dousing the growing scrutiny of Hillary’s unusual relationship with her closest aide.

The Muslim Brotherhood’s charter explicitly states its plan to infiltrate the infidels’ highest ranks.  The sad thing is, I don’t think our betters are putting up much of a fight; do you?

Oh well.  Maybe President Palin can order an investigation into how the Muslim Brotherhood penetrated our government.  First witnesses: Bill and Hillary Clinton.

Jon Huntsman Admitted He Was Representing Barack Obama

One of the big excuses and counters to my argument that Jon Huntsman was disloyal to the President of the United States was that he wasn’t representing the President, but the United States.

And the people who make this argument usually say something like, “Well, he may have been disloyal to Obama, but he wasn’t loyal to the country and that’s who he represented.”

Except Jon Huntsman, in his own words, saw it differently. In a letter to Barack Obama dated August 16, 2009, in additional to calling Obama a “remarkable leader”, Huntsman wrote that he appreciated the President’s confidence in Huntsman’s “ability to represent you in China.”

So Jon Huntsman admitted he was representing Barack Obama to the Chinese, not the United States in generally. And he publicly began consideration of a Presidential campaign against the man he admitted he represented before ceasing that representation. The Newsweek article where he admitted he was considering it happened at the beginning of this year. Huntsman didn’t leave China until May 1st.

Republicans should not honor disloyalty to the President at this level, regardless of who that President may be.

Less than two months ago, buzzing from the president’s gutsy call to eliminate Osama bin Laden, liberal pontificators had practically sworn in Barack Obama for his second term. “For the GOP the sands are rushing through the hourglass,” Roger Simon wrote in a column whose title had wondered whether the president was “invincible.” He claimed that with Geronimo KIA, “the Republican field has been fried like an egg.” In reality, the president’s short-term popularity boost had fried the long-term judgment of his supporters.

The reasons to believe Obama a one-term president are many and well-grounded.

10. The Declaration of Independents

Candidate Obama attracted independents. President Obama repulses them. The president entered office with the approval of 62 percent of independents. The latest Gallup poll shows support of just 42 percent of independents. Similarly, the political moderates key to his election have deserted the president as immoderate policies have emerged. There simply aren’t enough liberals for Democrats to lose moderates and win elections. No Democratic candidate over the last half century has won the presidency without winning moderates.

9. A Redder America

Barack Obama faces a redder electoral map than he did in 2008. The 2012 presidential election is more than a year away, but the Electoral College has already shifted twelve votes away from blue states and toward red states.

Meat grown artificially in a laboratory could offer a viable solution for environmentalists who want to cut their carbon footprint but cannot face going vegetarian, research suggests.

An Oxford-led study found that cultured tissue could reduce the greenhouse gas emissions from food production by as much as 96 per cent.

The process would use up to 45 per cent less energy than conventional meat, only one per cent of the land and a tiny fraction of the water required, according to a study to be published in the journal Environmental Science Technology.

Meat production is responsible for about 18 per cent of global greenhouse gas emissions – more than the airline industry and the world’s cars combined – and takes up almost a third of land outside of icebound areas.

With hundreds of millions more people in countries such as China now able to afford meat as part of their daily diet, the world’s resources have come under increasing pressure.

Meat production is being blamed for much of the deforestation in areas such as the Amazon rainforest, water shortages and increasing competition for land.

The late South African economist William Hutt, in his 1964 book, “The Economics of the Colour Bar,” said that one of the supreme tragedies of the human condition is that those who have been the victims of injustices and oppression “can often be observed to be inflicting not dissimilar injustices upon other races.”

Born in 1936, I’ve lived through some of our openly racist history, which has included racist insults, beatings and lynchings. Tuskegee Institute records show that between the years 1880 and 1951, 3,437 blacks and 1,293 whites were lynched. I recall my cousin’s and my being chased out of Fishtown and Grays Ferry, two predominantly Irish Philadelphia neighborhoods, in the 1940s, not stopping until we reached a predominantly black North or South Philly neighborhood.

Today all that has changed. Most racist assaults are committed by blacks. What’s worse is there’re blacks, still alive, who lived through the times of lynching, Jim Crow laws and open racism who remain silent in the face of it.

Last year, four black Skidmore College students yelled racial slurs while they beat up a white man because he was dining with a black man. Skidmore College’s first response was to offer counseling to one of the black students charged with the crime. In 2009, a black Columbia University professor assaulted a white woman during a heated argument about race relations. According to interviews and court records obtained and reported by Denver’s ABC affiliate (12/4/2009), black gangs roamed downtown Denver verbally venting their hatred for white victims before assaulting and robbing them during a four-month crime wave. Last year, four black Skidmore College students yelled racial slurs while they beat up a white man because he was dining with a black man. Skidmore College’s first response was to offer counseling to one of the black students charged with the crime. In 2009, a black Columbia University professor assaulted a white woman during a heated argument about race relations. According to interviews and court records obtained and reported by Denver’s ABC affiliate (12/4/2009), black gangs roamed downtown Denver verbally venting their hatred for white victims before assaulting and robbing them during a four-month crime wave. Earlier this year, four black girls beat a white girl at a McDonald’s, and the victim suffered a seizure.

None of these incidents are ever prosecuted as hate crimes, if they are prosecuted at all. Of course in far too many jurisdictions, the government, while not maintaining law and order by prosecuting these crimes, does indeed prosecute to the hilt otherwise law-abiding citizens who choose to carry their own forms of protection.

Smells like anarchy to me.

Status report from the White House: Obama’s view on gay marriage still “evolving”

I don’t know what’s left to say that I didn’t say six months ago when he last lied about this issue, but in case you’re wondering whether he’s still pretending to be against gay marriage: Yep. Still.

But maybe not for much longer.

This week, he will headline a $1,250-a-plate “Gala with the Gay Community” in Manhattan, his first such event as president; on June 29, he will host a Gay Pride reception at the White House. He is doing so at time when the New York Legislature is considering whether to make same-sex marriage legal — a vote that the president will no doubt be asked about while in New York.

The White House would not comment on whether Mr. Obama was ready to endorse same-sex marriage. But one Democratic strategist close to the White House, speaking only on the condition of anonymity, said some senior advisers “are looking at the tactics of how this might be done if the president chose to do it.”

And Representative Barney Frank, a Massachusetts Democrat who is gay, said in an interview that a top adviser to Mr. Obama, whom he would not name, asked him this year, “What would be the effect if he came out for same-sex marriage?”

“My own view is that I look at President Obama’s record, he was probably inclined to think that same-sex marriage was legitimate, but as a candidate for president in 2008 that would have been an unwise thing to say,” Mr. Frank said. “And I don’t mean that he’s being hypocritical. I mean that if you live in a democratic society, it is a mix of what you think the voters want and what you think is doable.”

A Democratic strategist claims that Obama’s position is “evolving” because he’s begun to view the issue in terms of his presidential legacy, which is a polite way of saying, “He may need to do something special for his base this year to keep the campaign money coming.” To some extent he’s a victim of circumstance, partly because New York may be about to push this issue back onto the national radar and partly because one of his spokesmen was dumb enough to tell progressives last week that Obama didn’t personally complete the candidate questionnaire in 1996 in which he said he was in favor of gay marriage. (Carney backs off that claim here and cuts their losses by admitting that he did fill it out.) Expect a Romney-esque dodge if/when he’s questioned about it at the NY fundraiser, with O insisting that while he’s not quite ready to endorse gay marriage in the abstract, he’s a gung-ho federalist who fully supports states experimenting with it if they so choose — so long as they arrive at the right outcome. For some reason, ostensible gay-marriage opponent Barack Obama dislikes it when a state’s majority opposes gay marriage like he does. C’mon, champ: If a RINO candy-ass like me can get away with backing gay marriage on a righty blog, surely the president can risk a little candor with independent voters.

In all the years that Obama’s been lying about this, has even a single reporter pressed him on what he means when he says his views are “evolving”? The evolution’s allegedly been ongoing since he first ran for Senate in 2004; that’s almost seven years he’s had to work through this issue. It took him nine months to pass ObamaCare, two years to execute a surge strategy in Afghanistan, and a couple of weeks to decide whether he needs congressional approval to bomb Tripoli legally, but somehow the question “do I think gays should have a right to marry?” is a brain-buster that’s taken him the better part of a decade to answer. Okay.

The Democrats’ Recall Bomb

Over the next week, we’re going to hear a lot, good or bad but not indifferent, about the Wisconsin recall elections.  To recapitulate: the climax of last winter’s wild and lengthy campaign against Gov. Scott Walker’s public-employee reforms was a threat to recall a number of state representatives who had voted in favor of the bill.  The Wisconsin left carried out the threat and now the day of reckoning is at hand.  (A smaller number of Democrats who fled to Illinois to deprive the state Senate of a quorum were also hit with recall petitions.)

The question of the public employee bill was settled permanently by the State Supreme Court last week in a decision that overthrew Judge Maryann Sumi’s attempt to interfere with implementation of Walker’s reform plan.  But the recall elections are still hanging over Wisconsin’s politicians.  The left-liberals have got themselves a new political weapon.

Democrat inability to prevail at the ballot box has led to tactics of desperation.  Falling numbers of Democratic voters (the number of registered Democrats stands at just over 43% today, scarcely a plurality) have loosened the hold of Democratic political machines across the country, letting light and air into districts that have not been part of the country’s culture of democracy for generations.  As a result, we have seen the introduction of all sorts of novel electoral tactics, usually backroom stuff that would be familiar to Boss Tweed and Frank Hague: endless recounts spiced up by ballots appearing out of quantum black holes, opponents being denied places on the ballot by legal action (a Cook County special strongly endorsed by none other than Barack Obama), voting by felons and illegal immigrants.  Frivolous recall elections are simply the latest of these.

A recall election is one of those things in which the perpetrators win even if they lose.  An incumbent surviving a recall has wasted money, time, and energy, has suffered diversion from his actual work, and must deal with the bad publicity inevitably arising from the effort.  Recall elections have no apparent downside for the left; it’s a wonder they haven’t been using them all along.

If successful in Wisconsin, we can expect hundreds if not thousands of attempted recalls across the country, on any pretext or none.  It will become a standard part of the electoral cycle, much the same as accusations of fraud and frivolous lawsuits have since the 2000 presidential election.  Fraud accusations, legal action, and demands for recounts that can be manipulated each have had some success, but each has limitations as well.  With the bogus recall, leftists are obviously hoping to have found a political neutron bomb that can be used at will with no damage to them.

Current such efforts are not limited to Wisconsin.  In New Mexico, a campaign to recall Russell Pearce, the worst enemy of illegal immigration in this country, has been kicked off with some success.  Pearce is the man who stood up to both the illegals and their enablers on this side of the border — not forgetting the ones in the White House.  He is close to being the indispensable man on this issue.  And that’s the point: recalls can be used to target key figures who are otherwise invulnerable, from Michele Bachmann to Chris Christie.  It’s evident we’re in the Spanish Civil War phase of this particular development cycle, in which the new weapons are tried out and perfected.  Soon enough — perhaps in 2012 — our friends on the left will set out to invade Poland.

So what is our team doing about it?  Not very much at all, it seems.  The Republican National Committee has shown no sign of even being aware of the threat.  The Northeast conservatives, evidently considering it to be some sort of Midwestern problem beneath their notice, are busily handicapping the 2012 election and have no time for lesser issues.  It’s all quite typical of the conservative establishment: look the other way until the ceiling falls in, then panic, then write policy papers telling somebody else what to do.

But what can be done?  Wisconsin Republicans have hit on one solution: threatening Democratic pols with recalls of their own.  The one thing that liberals have overlooked (they always overlook something) is that abusing the recall system creates a hostage situation as regards their own people.  The left has forgotten that the political system on its most basic level operates on the principle of reciprocity — you stick with the rules because if you break them, something will come straight through the hole you made and get you.  This is a lesson that needs to be reiterated, by means of actual demonstration, as often as necessary.  If you break out the nukes in a snowball fight, you will be made to pay for it.  The Democrats have been flouting this truism since Bush v. Gore, if not earlier.  They need their attention concentrated.  Wisconsin’s method is as good as any.

The Shame of the American Meteorological Society

I am very disappointed at the downward path the AMS has been following for the last 10-15 years in its advocacy of the Anthropogenic Global Warming (AGW) hypothesis. The society has officially taken a position many of us AMS members do not agree with. We believe that humans are having little or no significant influence on the global climate and that the many Global Circulation Climate Model (GCMs) results and the four IPCC reports do not realistically give accurate future projections. To take this position which so many of its members do not necessarily agree with shows that the AMS is following more of a political than a scientific agenda. …

We AMS members have allowed a small group of AMS administrators, climate modelers, and CO2 warming sympathizers to maneuver the internal workings of our society to support AGW policies irrespective of what our rank-and-file members might think. This small organized group of AGW sympathizers has indeed hijacked our society.

James Hansen’s predictions of global warming made before the Senate in 1988 are turning out to be very much less than he had projected. He cannot explain why there has been no significant global warming over the last 10-12 years.

Many of us AMS members believe that the modest global warming we have observed is of natural origin and due to multi-decadal and multi-century changes in the globe’s deep ocean circulation resulting from salinity variations. These changes are not associated with CO2 increases. Most of the GCM modelers have little experience in practical meteorology. They do not realize that the strongly chaotic nature of the atmosphere-ocean climate system does not allow for skillful initial value numerical climate prediction. The GCM simulations are badly flawed in at least two fundamental ways:

1. Their upper tropospheric water vapor feedback loop is grossly wrong. They assume that increases in atmospheric CO2 will cause large upper-tropospheric water vapor increases which are very unrealistic. Most of their model warming follows from these invalid water vapor assumptions. Their handlings of rainfall processes are quite inadequate.

2. They lack an understanding and treatment of the fundamental role of the deep ocean circulation (i.e. Meridional Overturning Circulation – MOC) and how the changing ocean circulation (driven by salinity variations) can bring about wind, rainfall, and surface temperature changes independent of radiation and greenhouse gas changes. These ocean processes are not properly incorporated in their models. They assume the physics of global warming is entirely a product of radiation changes and radiation feedback processes. They neglect variations in global evaporation which is more related to surface wind speed and ocean minus surface and air temperature differences. These are major deficiencies.

It is surprising that GCMs have been able to get away with their unrealistic modeling efforts for so long. One explanation is that they have received strong support from Senator/Vice President Al Gore and other politicians who for over three decades have attempted to make political capital out of increasing CO2 measurements. Another reason is the many environmental and political groups (including the mainstream media) have been eager to use the GCM climate results as justification to push their own special interests that are able to fly under the global warming banner.

Faking sea level data?

If you can fake it there, you can fake it anywhere. (Insert your own Sinatra soundtrack here.) Generally, when I see stories popping up about climate data which winds up having a, shall we say, “dubious” pedigree, it’s coming from the UK. But never let it be said that America isn’t competitive. Out in Colorado, the Sea Level Research Institute is facing increased scrutiny after it was revealed that they’ve been “adjusting” their data for a while now. (Before we get to the quotes, quick show of hands… how many of you even knew we had a “sea level research” program?)

Is climate change raising sea levels, as Al Gore has argued — or are climate scientists doctoring the data?

The University of Colorado’s Sea Level Research Group decided in May to add 0.3 millimeters — or about the thickness of a fingernail — every year to its actual measurements of sea levels, sparking criticism from experts who called it an attempt to exaggerate the effects of global warming.

“Gatekeepers of our sea level data are manufacturing a fictitious sea level rise that is not occurring,” said James M. Taylor, a lawyer who focuses on environmental issues for the Heartland Institute.

Why the revisions? Apparently they claim that it’s because of glacial isostatic adjustment. Basically it describes the gradual, slight rise of continental land masses which means that the ocean basins can hold a bit more water. (Again… who knew?)

So it looks like the institute decided to fudge the sea level data a bit to represent how high the levels would be if land wasn’t rising also. I don’t know about you, but if the major concern is ocean levels rising and swallowing up the coastlines, I’d think you’d want to measure the actual ocean levels, no? It reminds me a bit too much of when meteorologists go on and on with comparisons of wind chill factor on temperature readings. I’m really not interested in how cold it would seem if the wind wasn’t blowing. The wind is blowing, and I’d like to dress properly before I take Max out for his walk, thank you very much.

Republicans Flicker On Light Bulb Ban Repeal

The Republican House is flinching on passing the simplest and most symbolic piece of legislation this term: repeal of the incandescent light bulb phase out.  Amidst great fanfare and promises to restore limited government, the new majority is proving it isn’t much different than the old majority.

The incandescent phase out required under the so-called Energy Independence and Security Act of 2007 starts with banning regular 100 watt light bulbs on Jan 1, 2012. 75 watters will be banned a year later.  60 watters  fade in 2014. 

Some of us still cling to a quaint notion that federal legislation ought to pass constitutional muster while fixing a problem serious enough to fix and do so while providing more benefits than the costs to implement.  The light bulb ban fails to achieve all three:

1) it is unconstitutional (see my previous screed on this aspect);

2) is a solution without a problem; and

3) bears costs far in excess of any benefits.

The light bulb ban was inspired by environmental and energy conservation zealots spooked by the global warming lobby.  And those economic rent-seeking players in the lighting industry who could benefit from legislated self-interest, were happy to join as co-conspirators. Those companies who were less enthused about the light bulb ban found resisting futile, in the end happy enough to delay the effective dates to allow for more orderly close down of factories and job eliminations.

So, what have learned since 2007?  For starters, the global warming agenda has collapsed, polluted with data manipulation scandals.  And where the data haven’t been tainted by hyper-partisans, independent measurements are proving that global warming predictions are as useful as pre-season college football polls.

We have also learned that coal fired power plants, the leading villain in the light bulb ban morality play, haven’t been affected one whit by energy conservation mandates for households.  In fact not a single coal fired power plant has been taken off-line as a result of the steady conversion from household incandescents to CFLs in the past 5 years, and none ever will be.  Those hyper-partisans from the likes of the Natural Resources Defense Council predicting that 30 coal fired plants would be eliminated due to the light bulb ban have never been challenged to name one.   Name one,  just one.  Coal fired plants may get the axe from draconian EPA regs, but not from household light bulbs.

Defenders of the light bulb ban have failed to provide a single rationale why the government should meddle with consumer light bulbs.  Do they present a safety hazard?  No, certainly unlike the most prevalent replacement, the CFL laden with mercury.  Do they present a performance or quality scam?  Of course not, light output and reliability from incandescent light bulbs for household use has been the gold standard perfected over 75 years.  And compared with any other light source that contains no hazardous components, incandescent light bulbs are still the cheapest product on the shelf.

The last remaining defense for the federal light bulb ban coming from NEMA, the National Electrical Manufacturers Association, the trade group for the light bulb industry, is the pre-emption defense.  Because several states, notably California, were poised to enact their own consumer light bulb statutes — all different — the feds had to step in to create harmony.  This is the bureaucrat’s defense, devoid of principle, arguing that bad legislation is better than something worse.  If individual states want to enact different product standards, let the marketplace decide whether manufacturers will produce such versions and let those states bear the higher costs for their commercial isolationism.

No doubt Congressional Republicans who aided and abetted the 2007 light bulb ban, are now feeling sheepish, unwilling to admit they were bumfuzzled and bamboozled.  Rather than admit a mistake having negligible consequences in confessing, they would rather persist in a supporting a law that completely contradicts the Republicans’ new agenda — less government interference, fewer regulations, moratoria on cost burdens passed on to businesses and consumers, and restored liberties to the people.

There is no downside for any Republican, and even many conservative Democrats, to vote yes on the light bulb ban repeal. Who would be harmed by a repeal?  Workers facing layoffs or those already unemployed?  Consumers facing fewer, more expensive and less effective choices on retail shelves?  Retailers faced with ultra-life lightbulb substitutes seeing less traffic in their housewares aisles? Environmentalists and parents of young children who now have to cope with broad spectrum mercury contamination from kitchens and bedrooms to landfills?

What is the upside to vote upholding the light bulb ban?  Is there any?

Who else would benefit from the repeal? Anyone in Congress who wants to get re-elected.   And in addition to workers, consumers, retailers and environmentalists, the Republicans would benefit from proving their bona fides.  The Republicans were swept into power by the force of the limited government agenda.  Repealing the light bulb ban would at least be a symbolic victory, perhaps paving the way for more ambitious reversals. 

Will the Republicans deliver the simplest legislative win on the path to stopping government interference in our daily lives — a task as easy as naming a post office? If not, there is no hope for repealing ObamaCare, reforming entitlements, reversing the EPA, enacting a balanced budget, or restoring the principles of limited government to this nation.

On Jon Huntsman: See, I Told You So

My objection to Jon Huntsman remains simple: while serving at the pleasure of the President of the United States, he began plotting against the President of the United States. It matters not who the President is. It matters that the man was disloyal to his President while serving as his mouth piece to our biggest strategic adversary in the world.

Many people responded to my objection by saying, “he never campaigned or did anything to start campaigning while serving the President.” This statement is made in direct contravention to the public facts and record.

And now even the Los Angeles Times concedes that I was right.

Huntsman’s campaign, while he was still serving as ambassador, began lining up speaking gigs for him in key primary states. Huntsman says he had no connections to the people doing this on his behalf, but the facts show otherwise.

Did Jon Huntsman violate the Hatch Act, a federal law prohibiting political appointees from engaging in politics? It does not look good for Huntsman and you can bet that, should he be the nominee, the media will do to him with Hatch Act allegations what they’ve done for two years to Sarah Palin.

At least with Huntsman it will be deserved.
